How Virginia Defines Manslaughter

Under Virginia law, manslaughter is the unlawful killing of another person without malice. That absence of malice is the legal line that separates manslaughter from murder. Malice under Virginia law doesn’t simply mean intent; it refers to an act carried out with viciousness or evil purpose. Manslaughter lacks that element, but it remains a felony with consequences that can reshape every aspect of a person’s life.

Virginia defines voluntary manslaughter primarily through case law rather than statute, while Virginia Code §§ 18.2-35 and 18.2-36 govern the punishment of voluntary and involuntary manslaughter respectively. A charge can arise even when a person had no intention of causing death. The state of mind at the time of the act and the surrounding circumstances determine whether the charge applies and which category it falls under.

Three Types of Manslaughter Charges in Virginia

Norfolk defendants may face one of three distinct manslaughter charges, each with its own legal standard and sentencing range.

Voluntary Manslaughter

Voluntary manslaughter is an intentional killing committed in the heat of passion, provoked by extreme circumstances, without premeditation or malice. Under Virginia Code § 18.2-35, it is a Class 5 felony carrying one to 10 years in prison and a fine of up to $2,500. The jury or court may instead impose up to 12 months of jail confinement at their discretion. If sufficient time passed for a reasonable person’s passion to cool before the act, the charge may be elevated to murder.

Involuntary Manslaughter

Involuntary manslaughter is an unintentional killing resulting from reckless or negligent conduct, or from an unlawful act that is not a felony. Virginia Code § 18.2-36 classifies it as a Class 5 felony with the same one-to-10-year sentencing range and no mandatory minimum.

Aggravated Involuntary Manslaughter

When an unintentional death occurs while someone is driving under the influence, Virginia Code § 18.2-36.1 governs the charge. If the conduct was so gross, wanton, and culpable as to show reckless disregard for human life, the charge may become aggravated involuntary manslaughter under § 18.2-36.1(B), carrying a mandatory minimum of one year and a maximum of 20 years in prison along with mandatory driver’s license revocation.

All manslaughter convictions are felonies in Virginia. Beyond imprisonment, a conviction can strip voting rights, firearm rights, and create lasting barriers to employment and housing.
