What Virginia’s BUI Law Actually Covers

Virginia Code Section 29.1-738 prohibits operating any watercraft while impaired. The statute reaches motorboats, sailboats, yachts, canoes, kayaks, jet skis, water skis, surfboards, and sailboards. Scuba and spearfishing operations fall under it as well. If you were on the water operating virtually any vessel or craft, this law applied to you.

BAC Thresholds & Drug Limits

The per se blood alcohol concentration limit is 0.08%. For operators under 21, that threshold drops to 0.02%. The statute also sets drug-specific per se limits: cocaine at 0.02 mg per liter of blood; methamphetamine and MDMA each at 0.1 mg per liter of blood; and PCP at 0.01 mg per liter of blood. A person can also be charged below the 0.08% threshold if an officer observed speech, behavior, or movement indicating impairment.

Who Enforces BUI on Hampton Roads Waters

Enforcement authority on Virginia state waters belongs to conservation police officers from the Virginia Department of Wildlife Resources. On federal navigable waters, including portions of Hampton Roads Harbor and the Elizabeth River around Norfolk, the U.S. Coast Guard holds that authority. Both agencies patrol the waters where Norfolk boaters recreate, and which agency made the contact shapes how a stop is analyzed.

Potential Penalties for a BUI Conviction in Virginia

A first BUI conviction is a Class 1 misdemeanor, carrying a potential sentence of up to 12 months in jail and a fine of up to $2,500. Beyond the criminal sentence, a first conviction can result in loss of boating operating privileges for 12 months. A second or subsequent conviction within 10 years can extend that suspension to three years.

A BUI conviction becomes part of a permanent criminal record, which can surface in background checks and affect employment and insurance rates. When a BUI results in the unintentional death of another person, the charge escalates to involuntary manslaughter under Virginia Code Section 18.2-36.2. If the conduct is found to be grossly wanton, the charge becomes aggravated involuntary manslaughter, a felony carrying a mandatory minimum of one year and up to 20 years in prison. Courts may also require completion of a Virginia Alcohol Safety Action Program (VASAP)-certified program as a sentencing condition.

Implied Consent on Virginia Waterways

Virginia’s implied consent law extends beyond roads to waterway operation. By operating a boat on Commonwealth waters, you consent to breath or blood testing upon arrest on suspicion of BUI. Refusing carries its own consequences: a first refusal can result in loss of boating operating privileges for one year, and a second refusal within five years can mean a two-year suspension. Chemical testing must also follow proper procedures to be admissible, and improper administration or faulty equipment can be grounds to challenge a result regardless of what it shows.

BUI Defense Strategies That Road DUI Cases Don’t Require

Defending a BUI charge involves considerations that don’t arise in road DUI cases. Field sobriety tests administered after hours on the water may be compromised by physical factors that have nothing to do with alcohol: the rocking motion of a vessel, prolonged sun and heat exposure, and the balance disruption that comes with time spent at sea. These factors can produce results that look like impairment even in a completely sober person.

Probable cause analysis also works differently on the water. Road DUI stops often begin with a traffic infraction. Waterway contacts frequently arise from a boating accident, a registration check, or a general safety inspection, each of which shapes the probable cause question differently. If an officer lacked lawful grounds to stop or detain you, the arrest and any evidence collected may be challengeable. Breathalyzer calibration and blood testing protocols must also be correctly followed for results to survive a legal challenge.
